IMPORTANT LEGAL NOTICE

Please read these Terms and Conditions carefully before utilizing the freight forwarding, customs clearance, courier, or delivery services provided by Reggae Route Shipping. By creating an account, sending goods to our designated international hubs, or accepting delivery of any item, you ("the Customer") enter into a legally binding agreement with Reggae Route Shipping, governed exclusively by the laws of Jamaica.

1. Service Description

  • 1.1 Scope of Authority: Reggae Route Shipping provides comprehensive logistics, freight forwarding, and domestic courier services including international air freight, international sea freight, and island-wide ground transportation across Jamaica. By utilizing our services, the Customer appoints Reggae Route Shipping as their lawful agent for the purposes of customs clearance, handling, and domestic distribution.

  • 1.2 International Air Freight Services: Air freight operations consist of receiving the Customer's packages at our designated US logistics facility, manifest preparation, security screening, international air transport to Jamaica, handling, and presenting items to the Jamaica Customs Agency (JCA) for examination and assessment of duties.

  • 1.3 International Sea Freight Services: Sea freight services specialize in the consolidation, transport, and customs clearance of larger cargo, specifically utilizing standard Sea Barrels, crates, and heavy commercial/personal consignments. Sea freight operates on a scheduled shipping manifest timeline from our international consolidation hubs.

  • 1.4 Ground Transportation and Delivery Services: Reggae Route Shipping offers specialized localized delivery mechanisms within its primary service areas across Jamaica. This includes an optional Personal Delivery Service executed directly to the Customer's designated residential or commercial physical address at a standardized rate of $700 JMD per delivery.

2. Customer Responsibilities

  • 2.1 Accurate Documentation and Pre-Alerts: The Customer must ensure that all packages shipped to our international facilities are properly addressed, including their unique Account Number. The Customer is legally required to upload a legitimate, unaltered commercial invoice (merchant proof of purchase) via our web portal or mobile application immediately upon purchase. Estimated values or pro-forma invoices are not accepted for customs clearance purposes.

  • 2.2 Packaging and Outer Markings: It is the sole responsibility of the Customer or the original merchant supplier to pack all items securely to withstand the rigors of international air, sea, and land transport. Reggae Route Shipping accepts zero liability for internal contents damaged due to inadequate, fragile, or improper commercial merchant packaging.

  • 2.3 Package Weight and Dimension Specifications: Reggae Route Shipping imposes no maximum weight or size limits on general cargo packages. However, items exceeding standard courier dimensions or weighing over 70 lbs require special handling, may require custom mechanical offloading equipment, and must be coordinated with our customer support team prior to arriving at our international hubs.

3. Company Responsibilities

  • 3.1 Standards of Care: Reggae Route Shipping shall exercise reasonable care and diligence in the handling, storage, and transport of the Customer’s items from the exact moment of physical acquisition and logging at our international facilities until final physical handover to the Customer.

  • 3.2 Service Availability and Delivery Commitments: While Reggae Route Shipping makes every reasonable commercial effort to meet standard logistical timelines, all transit timeframes provided are non-guaranteed estimates. Time is not of the essence in this contract, and Reggae Route Shipping shall not be held financially liable for any losses, penalties, or secondary damages arising from transit, flight, or customs clearing delays.

4. Pricing, Freight Rates, and Payment Terms

All transactions, fees, and calculations are billed primarily in Jamaican Dollars (JMD) or the prevailing US Dollar (USD) equivalent where customs duties apply. Rates are subject to modification based on fluctuating international fuel surcharges and freight capacity rates.

4.1 Weight-Based Air Freight Scale

Air freight charges are derived from the actual gross weight or volumetric weight (whichever is greater) of the package, subject to the following structural brackets:

4.2 Sea Freight Barrel Standard Rate

Consolidated Sea Freight standard barrels are billed at a flat base rate of $290.00 USD (or the equivalent JMD conversion rate at the date of clearance) per barrel. This rate covers ocean freight and baseline terminal handling but excludes standard Jamaica Customs duties, environmental levies, and statutory structural clearing fees.

4.3 Ancillary Fees and Processing Surcharges

  • Processing Fee: A mandatory flat fee of $100 JMD is levied on every independent incoming package entry for manifest entry, labeling, and warehouse system sorting.

  • Personal Delivery Fee: An optional flat fee of $700 JMD applies to each delivery requested within our primary ground delivery networks.

4.4 Payment Terms

All accrued freight charges, processing fees, customs duties, storage fees, and delivery surcharges must be paid upfront and in full prior to or at the exact time of physical package collection or personal delivery. Reggae Route Shipping operates on a strict Cash-On-Delivery (COD) or Pre-Paid online gateway model. No credit or Net-30 accounts are extended to retail clients unless formally executed under a separate commercial corporate contract.

5. Liability and Insurance Limitations

  • 5.1 General Liability Cap: The total aggregate liability of Reggae Route Shipping for any proven loss, complete destruction, or misplacement of a package due to verified negligence of the company or its direct employees is strictly capped at a maximum limit of $100.00 USD (or its JMD equivalent) per transaction manifest entry. Reggae Route Shipping provides no automatic full-value replacement insurance unless a supplementary marine or air cargo transit insurance policy is purchased by the Customer prior to shipment.

  • 5.2 Complete Exclusions of Liability: Reggae Route Shipping accepts absolutely zero liability for:

    1. Indirect, incidental, special, or consequential damages (including but not limited to loss of business, profits, revenue, market share, or utility).

    2. Electrical, electronic, or magnetic injury, erasure, or corruption of digital data, photographic images, or recordings.

    3. Packages containing fragile items (glass, ceramics, crystal, delicate electronics) that have not been professionally packed inside a reinforced timber crate with inner foam molding.

  • 5.3 Damage and Loss Claims Procedure: Any claim for damage, partial loss, or structural shortage must be filed in writing to [email protected] within twenty-four (24) hours of package collection or delivery. The Customer must preserve the original shipping carton, outer plastic wrapping, and all merchant internal packing material for physical inspection by our general manager. Failure to file a claim within this 24-hour window constitutes absolute, unconditional waiver of any right to legal recourse or compensation.

6. Prohibited and Restricted Items

The Customer is strictly prohibited from shipping any items that are restricted under the Customs Act of Jamaica, Civil Aviation Authority rules, or international trade embargos. It is the Customer's duty to cross-reference their purchases with the Standard Jamaica Customs Blocked List.

CRITICAL NOTICE — STRICTLY PROHIBITED ITEMS: The following items shall not be accepted under any circumstances. If received, they will be immediately confiscated and handed over to the Jamaica Constabulary Force (JCF) or border authorities:

  • Firearms, imitation firearms, ammunition, components/parts of weapons, scopes, and tactical gear.

  • Explosives, fireworks, flares, matches, combustible fuels, and pressurized aerosol canisters.

  • Illicit narcotics, psychotropic substances, or unregulated prescription medications.

  • Pornographic material, obscene publications, and counterfeit currency/goods.

  • Live animals, restricted plants, soil samples, and perishable raw meat/poultry products.

  • Radar detectors, camouflage clothing patterns (illegal for civilian possession under Jamaican law).

Any fines, statutory penalties, legal expenses, or operational delays incurred by Reggae Route Shipping as a direct result of restricted items discovered within the Customer’s shipment shall be billed directly to the Customer, and their account will be terminated with immediate effect.

7. Delivery Terms, Failed Attempts, and Storage Fees

  • 7.1 Standard Delivery Timeframes: Standard domestic delivery timeframes are 1 to 2 business days after the package status has officially been updated and listed within our customer tracking system as "Ready for Pickup" or "Out for Delivery".

  • 7.2 Operating Hours and Weekend/Holiday Availability: Our corporate storage facilities and distribution collection points operate strictly according to the following standard schedule:

    • Monday to Friday: 9:00 AM – 5:00 PM

    • Saturday: 11:00 AM – 4:00 PM

    • Sunday: Closed

    • Public Holidays & Special Weekend Service Availability: 11:00 AM – 4:00 PM (subject to pre-announced regional distribution adjustments)

  • 7.3 Failed Delivery Procedures: For Personal Delivery Services, our courier will make a maximum of two (2) attempts to complete delivery to the address provided. If the Customer or their authorized representative is unavailable to accept delivery, the package will be returned to the main collection warehouse, and the Customer will be required to physically pick up the item. The original $700 JMD delivery fee remains fully payable and will not be refunded or credited.

  • 7.4 Warehouse Storage Fees: Packages will be held free of charge at our collection points for a maximum grace period of three (3) calendar days. Starting on the fourth (4th) day, packages remaining uncollected shall incur a mandatory storage fee calculated as: $50 JMD per package per day.

  • 7.5 Abandonment of Cargo: Items left uncollected for more than thirty (30) calendar days from the initial "Ready for Pickup" notification shall be deemed completely abandoned. Reggae Route Shipping retains the absolute legal right to auction, destroy, or sell such abandoned cargo to recover accrued freight, storage, and processing costs without further notice or liability to the Customer.

8. Force Majeure

Reggae Route Shipping shall not be held liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control ("Force Majeure"). This includes, but is not limited to: Acts of God, tropical storms, hurricanes, earthquakes, floods, severe weather patterns, airline delays or cancellations, acts of war, civil unrest, labor strikes, pandemics, national lockdowns, delays or systemic holds by the Jamaica Customs Agency, or unilateral border closures by government authorities.

9. Dispute Resolution and Governing Law

  • 9.1 Internal Complaint Mechanism: In the event of a dispute arising out of or in connection with our services, the Customer must first submit a formal grievance in writing to the General Manager at [email protected]. Both parties agree to engage in good-faith mediation for a mandatory period of no less than thirty (30) business days from the receipt of the complaint notice before pursuing secondary legal remedies.

  • 9.2 Governing Law and Jurisdiction: These Terms and Conditions shall be governed, construed, and enforced strictly in accordance with the laws of Jamaica. Any litigation, judicial review, or legal action arising under this contract must be brought exclusively in the courts of Jamaica located in Kingston.

10. Privacy and Data Protection

Reggae Route Shipping operates in compliance with the Data Protection Act of Jamaica (2020). We collect personal identifiable information (name, address, telephone number, TRN, government ID copies) solely to facilitate international shipping manifests, freight logistics, and customs validation. We do not sell, rent, or lease our customer databases to any third-party marketers. Data is only disclosed to official government regulatory bodies, law enforcement agencies, and the Jamaica Customs Agency when requested under valid legal framework.

11. Modification of Terms

Reggae Route Shipping reserves the right to modify, amend, adjust, or completely rewrite these Terms and Conditions at any time. Any updates will be published directly on our website and notice boards. Continued use of our logistics network, addresses, or services after the date of an amendment constitutes immediate, binding acceptance of the updated terms by the Customer.

12. Termination Clauses

The Customer may request account closure at any time, provided all pending invoices, customs duties, and storage balances have been paid in full. Reggae Route Shipping reserves the absolute right to unilaterally terminate or suspend any Customer account, profile, or access token with immediate effect and without prior warning if the Customer engages in fraudulent activity, provides false customs documentation, uses abusive language toward staff, or violates any clause of these Terms.

13. Refund Policy and Payout Procedures

  • 13.1 Refund Requests: Refunds are only issued in cases where double-billing has occurred, or where freight charges were erroneously overcharged due to a physical system weighing malfunction. No refunds will be issued for packages delayed by airlines, weather conditions, or normal Jamaica Customs processing schedules.

  • 13.2 Payout Procedures: All approved refunds will be credited back via the original method of payment (e.g., online credit card reversal or direct Jamaican bank transfer) within ten to fourteen (10-14) business days. Cash payouts at retail counters are strictly forbidden for security purposes. All refunds must be approved by the General Manager.
